Privacy and Confidentiality is the basis of therapeutic trust between therapist and client. Successful therapy relies on a deep trust and understanding of the client and their presenting problem. Included in the Intake is a “Confidentiality Agreement” signed by both therapist and client. What happens in counseling sessions is not discussed elsewhere unless “Informed Consent” is given to share information with members of your care-team (Doctor, Psychiatrist, School Counselor, Attorney or Court official). However, no information is shared unless a signed release has been given to the therapist by the client to release the information. 

Current New York State law and Professional Counseling Ethics require therapists to maintain confidentiality except for the following situations:
  • Suspected abuse or neglect (current or past), of children, adults, and elders to authorities, including Child Protective Services, and law enforcement, based on information provided by the client or collateral sources.
  • If the therapist has reason to suspect the client is seriously in danger of harming him/herself or has threatened to harm another person.
